How can I make a claim if my tenancy agreement has expired and I have already left the property?

If I make a tenancy deposit claim, and still reside in the property on which I am claiming, can I be evicted or served with a notice to leave the property?
The simple answer to this question is NO! If you are in a fixed term Assured Shorthold Tenancy (referred to as AST herein) i.e. you are still within the designated term of a tenancy period, you cannot be legally forced to leave your rented property until the end of the agreed lease/rental period. Any claim made, succesful or not, does not change this.
How can I make a claim if I am renting a property from a private Landlord?
Of course. Any private tenant who has let or rented a property from a private Landlord can make a claim if it meets the set criteria. Private tenants also includes students renting from a private Landlord.
There is more than one tenant registered on the tenancy agreement…do they all have to be part of the claim?
Whenever you enter into a tenancy agreement with one or more individuals, by law you are regarded as having ‘joint & several liabilty. This means that to register a claim, all parties must agree as in the eyes of the law, you are all legally one entity (joint & several). How can I still claim if I am receiving local housing benefit?
Claiming housing benefit does not mean you cannot make a claim. You can make a claim in most circumstances, so long as you paid the deposit personally. Again, please call us to discuss this aspect of a tenancy deposit claim in more detail.
I would like to make a claim on the property I currently rent….what would be the consequences of making a claim?
This is a difficult question to answer, and it all depends on how your Landlord reacts to your claim. It would be feasible to think that the Landlord would be unhappy with the claim and may decide to serve you with notice to vacate your property. PLEASE NOTE THAT YOUR LANDLORD CANNOT SERVE YOU WITH A NOTICE TO LEAVE UNTIL THE TENANCY DEPOSIT CLAIM HAS BEEN CONCLUDED. We would always advise you to provide us with the information to prepare a claim, but wait until you have a leaving date or an intened timeframe in which to leave prior to pursuing the claim.
Does it affect my tenancy deposit claim if I live outwith England or Wales?
Not neccessarily. Specific legislation applies to claims in England and Wales, and other laws apply to Scotland & Northern Ireland. We would encourage you to still get in touch as we may still be able to help with your claim.
